GENERAL PAYMENT

Payment for orders under $50 will be accepted in advance. For orders over $50, a non-refundable deposit will be accepted in advance, with the remaining balance to be paid upon approval/recipient of project.

A late fee will be issued if balances due are not paid by the agreed date. That fee of $5 will be added to the total amount each day the balance is in default. For payments that are late without notice, Kayla Kreates has the right to charge a late fee or terminate the project.

If you are no longer able to make payments, please contact me to discuss futher action. Projects will be placed on hold until payments are rendered.

RETURN POLICY

As an artist offering customized services, the grounds for returns/refunds are quite limited. Kayla Kreates is, however, open to making the necessary adjustments in order to ensure your ideas are realized.

For items being shipped, a refund request will certainly be honored if photos of damage are submitted within 1 week of delivery date.

KUSTOMIZATIONS

You are responsible for providing complete, accurate and timely information or specified materials needed to begin project.

All final designs must be reviewed and approved by you before the project is transferred.

ADJUSTMENTS

As highlighted in the Return Policy, KaylaKreates is open to making any necessary adjustments in order to ensure that your ideas are realized. Simple changes will gladly be made at no additional charge up to 5 times, after which a onetime fee of $50 will be added to the total amount to be paid.

In the event that you might recognize a need for a significant change in direction after having already approved the sample proof of the design, an adjustment fee will be incurred of $25 for every significant adjustment made.

ETA/TIMELINES

Kayla Kreates will ensure that you are aware of the project's ETA, and will request that you may be respectful of that time period. Below is a list of the estimated turnaround times associated with specific services:

• Digital Portrait: 1-2 Weeks

• Logo Design: 1-2 Weeks

• Average Painting: 1 Month

• Large Painting: 2-3 Months

• Oil Painting: Additional 2 Weeks Drying Time

CANCELLATIONS

Both parties understand that the Client and the Artist have the right to terminate a project at any time once begun, if, the relationship is deemed unsatisfactory by either party.

If a project is terminated before services are fully completed, Kayla Kreates, reserves the right to retain the non-refundable deposit. If the client decides to cancel the service after the final design approval is complete, Kayla Kreates, has the right to retain any payments made up until that point.

An attempt to resolve any issue that may arise during the process of the project will be made before issuing a refund.

COPYRIGHT/CREDIT

Kayla Kreates agrees to create original work for the client, under no plagiarism. The Artist holds all rights to any work created during the project until final payment is made and files have been transferred to client. The Client will then hold rights to the work once files have been transferred. Once the Client holds ownership, the original work should not be altered in any way without contacting the artist first.

Kayla Kreates reserves the right to use samples of work created under the agreement for marketing/promotional purposes. Credit to the client's business will be mentioned on all public/promotion of the project from Kayla Kreates.

LIMIT OF LIABILITY

Illness, injury, or other events beyond Kayla Kreates' control, such as fire, theft, computer failure or unforeseeable occurrences could result in a delay of production.

The Client agrees that they will not hold the Artist liable for any incidental consequential damages that arise from the Artist's failure to perform any aspect of the project in a timely manner under these circumstances.
